Welcome to Missty Club (the “Website”). These Terms and Conditions (“Terms”) govern your access to and use of the Website, and any associated services. By accessing or using the Website, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please refrain from using the Website. 

We are an online platform that provides advertising space for independent models and agencies. We do not operate as an escort agency. The information and content shared on this website are for advertising purposes only. By accessing or using the site in any way, including but not limited to browsing the site or contributing content, you agree to comply with these Terms and Conditions.

“User” refers to any individual or entity that accesses, registers, or interacts with the Website and its services, whether as a consumer of content, an uploader of content, or a participant in any Website-related activities. The User may utilise both free and paid services, and is subject to the terms outlined in this agreement. This term encompasses all roles, including content creators, consumers, and other participants.


1. Acceptance of Terms

By accessing or using the Website, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy, which is incorporated herein by reference.

 

2. Eligibility

You must be at least 18 years old to access or use the Website. By using the Website, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

The use of the Website is prohibited to persons under the age of majority in accordance with local jurisdiction. Any third party under the age of majority must cease using the Website immediately.

The Client/Contractor expressly acknowledges that he is solely responsible for all use of the Website as well as for any interaction with the Providers.

In case of violation of the rules or laws in the applicable jurisdictions by the Contractors, when placing information on the Website, the Administrator undertakes to remove this information upon a request from the copyright holder or other person whose rights have been violated when placing information on the Website by the Contractor.

A third party who requests the Administrator to delete information that violates his or her rights must prove that he or she has the relevant rights.


3. Changes to the Terms

We reserve the right to modify or update these Terms at any time. Any changes will be effective upon posting on the Website. It is your responsibility to review these Terms regularly. Your continued use of the Website after changes have been made constitutes your acceptance of the revised Terms.


4. Intellectual Property Rights

All intellectual property items (“Website Objects”) that are part of www.missty.club (the “Website”) or accessible through its features are protected by intellectual property law. This includes, but is not limited to, all information, texts, materials, graphic elements, designs, images, photos, videos, music, scripts, computer programs, services, and the structure of the Website. The rights to these intellectual properties belong to either the Website Administrator or other copyright holders, such as Contractors who contribute content.

Ownership of Intellectual Property

The Website Objects are the result of intellectual activity, and all rights to them are owned by the Administrator or other respective copyright holders. This includes content created or posted by Contractors, such as photographs uploaded to their profiles. Contractors are presumed to hold the intellectual property rights to the content they post.

Permissible Use of Website Objects

The use of Website Objects by Clients and Contractors is permitted only for personal, non-commercial purposes, and must adhere to the functional limits of the Website as outlined in this User Agreement. Any use of Website Objects outside the scope of the Website’s features—such as reproduction (copying by any means), distribution, public performance or display, modification, creation of derivative works, or other forms of use, including for commercial purposes—is strictly prohibited without prior written consent from the Administrator. Unauthorized use of Website Objects may result in legal action under international intellectual property law.

Citation and Quotation Guidelines

You may quote or reference Website Objects, but only if you properly attribute the content by specifying the author’s name and providing an active link to www.missty.club.

Protection of Intellectual Property

To prevent and address unauthorized use of Website Objects, the Administrator has the right to employ any necessary technical measures, including technologies and technical devices designed to control access to Website content. These measures may limit or prevent actions not authorized by the Administrator, such as restricting the number of devices that can access the Website simultaneously.

User-Generated Content and License Grant

Clients and Contractors who post reviews, comments, or other materials (“User Materials”) containing text, content, graphics, designs, images, photos, videos, or music grant www.missty.club and the Administrator a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute such content in any current or future media formats.

By posting User Materials, Clients and Contractors affirm that they have the legal right to do so and that their content does not infringe upon the copyrights or related rights of any third party, nor does it violate any trade secrets. At the time of posting, there should be no known circumstances that could give rise to third-party claims against the Administrator concerning such content.

In the event that third parties make claims regarding the infringement of their exclusive rights to User Materials, the Administrator reserves the right to remove the disputed content immediately upon receiving notice of the claim.

Ownership

When a User uploads a photo to www.missty.club, they retain ownership of the photo and the right to delete it at any time. Once a photo is deleted by the user, it will be permanently removed from all systems and databases associated with the Website. The Website does not retain, store, or archive deleted photos in any form, ensuring that once a photo is deleted, it cannot be recovered by any party, including the Administrator.


5. User Conduct

User Age and Legal Compliance By using this website, you confirm that you:

  • Are at least 18 years old (or the legal age in your jurisdiction).
  • Have the legal right to view adult content.
  • Will not allow any minors to access the content on this website.
  • Acknowledge that the website may contain adult material, including explicit photographs, videos, and other content.
  • Are responsible for ensuring that your use of this website complies with the laws of your jurisdiction.

Acceptable Use You agree to use the website only for lawful purposes and in a manner that does not infringe on the rights of others. The following activities are prohibited:

Missty.club reserves the right to verify the authenticity of user profiles and may request verification photos to confirm that the profile is legitimate. Failure to provide verification may result in account deactivation.

Content that contains nudity, explicit material, or illegal content will be removed without prior notice. Missty.club reviews all content to ensure compliance with its policies.


6. Account 

Registration

Some features of the Website may require you to register for an account. You agree to provide accurate and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account.

Paid features

By purchasing any paid features or services, such as Boost, Promo, or upgrading your account to a paid plan, you acknowledge and agree that all transactions are final and non-refundable. Once the purchase is confirmed, no refunds, credits, or exchanges will be provided for any reason, including but not limited to unused services or accidental purchases. We encourage you to carefully review your selection before completing any transaction.


7. Limitation of Liability

To the maximum extent permitted by law, Missty Club and its affiliates, partners, and licensors shall not be liable for any indirect, incidental, special, or consequential damages, or loss of profits or revenues, arising out of or in connection with your use of the Website or any content provided therein.

The Administrator shall not be held liable for:

  • Any damages caused to the Client/Contractor as a result of using the Website, including but not limited to, loss of data, infection of the Client/Contractor’s device with malware, phishing, or fraudulent activities by third parties.
  • Advertisements posted on the Website, including the content or legitimacy of third-party ads.
  • The content and availability of third-party websites that may be accessed via links on the Website, nor for the information, products, or services available on such third-party websites.

The Client/Contractor undertakes not to upload, store, publish, distribute, or provide access to content that violates the following guidelines:

  1. Pornography or explicit content involving minors, or promoting such activities.
  2. Descriptions or encouragement of suicide.
  3. Hate speech promoting racial, religious, or ethnic intolerance.
  4. Promotion of violence, cruelty, or criminal activities.
  5. Extremist or fraudulent materials.
  6. Content that violates third-party privacy or intellectual property rights.

If a User is found to be in violation of these guidelines or if their actions are deemed illegal, fraudulent, or harmful to the Website’s reputation, the Administrator reserves the right to block access to the Website and/or Personal Account without prior notice.

The Administrator is not responsible for the consequences of actions taken byUser based on information obtained from the Website. Should any materials posted on the Website infringe the rights of third parties, they will be promptly removed upon request.

  • The Website does not contain neither provide consultations. Any materials and information posted on the Website are the opinion of the authors of such materials and information and are not subject to verification by the Administrator. The User shall use the materials and information on the Website at his/her own risk and shall be solely responsible for any consequences of the use of such materials and information, including any losses that may be incurred directly or indirectly by the User or third parties.
  • The Administrator, unless otherwise established, assumes that no material and/or neither information posted on the Website infringes the legal rights and interests of third parties. If any material/information on the Website is found to infringe the legal rights and interests of third parties, such material/information will be removed from the Website on the first request of the person whose legal rights and interests have been infringed.
  • The Administrator shall not be liable for any damages caused to the User as a result of using the Website, including loss of data, infection of the User computer or other equipment with a computer virus, losses resulting from malware, phishing, fraud and other malicious and illegal activities of third parties on the Internet.
  • The Administrator is not responsible for advertisements posted on the Website.
  • The Website may contain links to third party websites on the Internet. These links do not constitute a recommendation or endorsement by the Administrator of such websites or the products offered on such websites. The persons who own such websites and their content are not checked by the Administrator for compliance with the requirements of the law. The Administrator shall not be responsible for the information and materials posted on the websites of third parties to which the User receives access through the Website, as well as for the availability of such websites, content, the content of advertising, opinions and statements on such websites and the consequences of their use.
  • The User undertakes not to upload, store, publish, distribute or provide access or otherwise use any information that:
    1. contains pornography and/or sexually texts or scenes of a sexual nature involving minors and/or announcements of engaging minors as performers to participate in pornographic entertainment events;
    2. contains a description of the means and methods of suicide, any incitement to commit suicide;
    3. popularization and/or promotes racial, religious, national, ethnic hatred or enmity;
    4.  promotes a cult of violence and cruelty;
    5. contains extremist materials;
    6. promotes criminal activity or contains advice, instructions or guides for committing criminal acts;
    7. contains limited access information, including, but not limited to, government and trade secrets, information on the private lives of third parties;
    8. promotes or describes the attractiveness of the use of narcotic substances, contains information about the distribution of drugs, recipes for their manufacture and consumption advice, contains information about the ways, methods of development, manufacture and use of narcotic drugs, psychotropic substances and their precursors, new potentially dangerous psychoactive substances, places of their acquisition, ways and places of cultivation of drug plants;
    9. is fraudulent in nature;
    10. denigrates the honor, dignity, business reputation of others;
    11. violates the privacy of other Users or third parties;
    12. contains slander, rude and insulting expressions and suggestions, offensive language;
    13. violates other rights of third parties and applicable international law.
  • The Administrator shall have the right to block the User access to the Website and/or Personal Account and/or services (including paid services) if the User violates the terms of this User Agreement, as well as if the Administrator considers the User actions to be illegal, fraudulent or aimed at damaging the Website or undermining its reputation.


8. Disclaimer of Warranties

The Website and its content are provided “as is” and “as available” without any warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Website will be uninterrupted, secure, or error-free, or that any defects will be corrected.

The Parties shall be liable in accordance with this User Agreement and international law for the non-performance or improper performance of obligations under this User Agreement.

The User uses the Website at their own risk. The Website and its services are provided to the User “as is,” without any express or implied warranties, including but not limited to, warranties of merchantability or fitness for a particular purpose.

The Administrator does not guarantee that:

  1. The Website and its functional features will meet the requirements of the User.
  2. Access to the Website and its functional features will be uninterrupted, timely, secure, or error-free.
  3. The results obtained from using the Website will be accurate, reliable, or suitable for any purpose.
  4. The materials and information on the Website are up-to-date or compliant with current legislation at the time of viewing by the User.
  5. The quality of the Website and its functional features will meet the expectations/requirements of the User.

The Website does not offer legal, medical, or professional consultations. Any materials and information posted on the Website are the opinions of their respective authors and are not subject to verification by the Administrator. The User shall use the materials and information on the Website at their own risk and bear full responsibility for any consequences, including any direct or indirect losses incurred as a result of using such materials and information.

Photo Upload and Deletion Policy

When a User uploads photographs or other media content to the Website, they grant the Administrator a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, place a watermark, adapt, publish, translate, and distribute such content in any existing or future media as outlined in the intellectual property section.

However, once a User deletes a photo or other media from their profile, the Administrator ensures that the deleted content is not stored, archived, or retained in any form within the Website’s systems, backups, or other storage facilities. Once the deletion process is initiated, all copies of the deleted media are permanently removed.

The Administrator is committed to protecting the privacy and intellectual property rights of Users by ensuring that once deleted, no further access to such content is possible. This policy applies to all photos and media content uploaded by Users on the Website.


9. Third-Party Links and Content

The Website may contain links to third-party websites or content. Missty Club is not responsible for the content, accuracy, or opinions expressed on such websites, and such websites are not investigated, monitored, or checked for accuracy or completeness by us. Your use of such third-party websites is at your own risk and subject to the terms and conditions of those websites.


10. Termination

We reserve the right to terminate or suspend your access to the Website, without notice, for any reason, including, but not limited to, breach of these Terms. Upon termination, your right to use the Website will immediately cease.


11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United Kingdom.


12. Indemnification

You agree to indemnify, defend, and hold harmless Missty Club, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising out of or in connection with your use of the Website, violation of these Terms, or infringement of any intellectual property or other right of any person or entity.


13. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.


14. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Missty Club regarding your use of the Website and supersede any prior or contemporaneous understandings, agreements, or communications between you and Missty Club.
